Shopper Terms
Version 2026-09-19
1. Parties and acceptance
These terms are an agreement between MysteryShopper.com.au Pty Limited (we, us) and you, the shopper. Where these terms limit our liability or give us the benefit of an indemnity, we and us also include our officers, employees and related companies. You accept these terms by agreeing to the current version before claiming a job. Each new version carries a new date, and you must accept the current version before your next claim. A job claimed under an earlier version remains subject to that version.
2. Eligibility and your details
You must be at least 18 years old and entitled to work in Australia. Your account is personal to you. You must not permit anyone else to use it or to perform a job on your behalf. The details you give us must be true, and you must keep them current. We may contact you about your jobs and your account. We send marketing messages only with your consent, which you may withdraw at any time.
3. Your status
You take part in jobs as a private recreational pursuit or hobby, not in the course of a business or enterprise, and you do not need an ABN to take part. By accepting these terms you make a written statement to that effect for the purposes of Australian tax law, and we rely on it: we do not withhold tax from your payments. You are not our employee, agent or partner, and nothing in these terms creates an employment, agency or partnership relationship with us or with any business whose location you visit. You have no authority to act for us or to bind us, and you must not hold yourself out as our employee or agent. You decide which jobs to claim and when to complete them within each job's window. You are responsible for any tax on what you receive, and for your own insurance, equipment and transport. To the extent the law allows, we provide no leave, superannuation, workers' compensation or insurance.
4. Jobs are not guaranteed
We do not guarantee that any job will be available to you. Which jobs you can see and claim depends on your location, on rules the business sets for its job, and on rules we apply, and we may change our rules at any time.
5. Claiming and completing a job
Claiming a job is a commitment to complete it within its window. You must check in at the location, follow the brief, and answer every question truthfully and in your own words. If you are unable to complete a job, you must release it as early as possible. Repeated failures to complete jobs, or late releases, may result in suspension or termination of your access.
6. Evidence
Answers, photographs and check-in locations must be accurate and captured during the job. You must not fabricate a job, reuse earlier photographs, or report anything you did not observe. Photographs and recordings may be taken only where the law permits, and not of individuals who have not consented. You must not disclose that you are a mystery shopper while at the location.
7. Fees and payment
The fee for a job is shown before you claim it and includes any purchase the brief requires. It is the only amount payable for the job, and no separate reimbursement is payable. A fee becomes payable when the report passes review and is paid in weekly payment runs to your nominated bank account through Stripe. Bank details are provided to and held by Stripe. A report rejected as incomplete, late or inaccurate is not paid. If a dispute concerning a job is upheld after payment, the payment may be reversed.
8. Work product
Your answers, photographs, recordings and any other material you submit for a job are work product produced for us and paid for by the job fee. On submission they become the property of MysteryShopper.com.au Pty Limited, and you assign to us all rights in them, including copyright, without further payment. To the extent the law allows, you consent to our use of them without attribution and waive any moral rights in them. We may use, edit, store and share the work product as we see fit, including with the business that posted the job. You confirm that you are entitled to submit it and that it does not infringe anyone else's rights. Suggestions and feedback you give us about the platform are ours to use without any obligation to you.
9. Confidentiality and conduct
Briefs, reports, photographs and scores are confidential to the business that posted the job and must not be disclosed to any other person or published. Information about us that is not public, learned through a job or the platform, is also confidential. You must act lawfully and respectfully at every location and comply with reasonable directions from staff.
10. Personal information
To operate the platform and pay you, we collect and hold your name, email address, telephone number, your location at check-in, photographs taken during a job, and the result of your identity verification, which is performed by our verification provider. Reports and photographs are shared with the business that posted the job. We do not sell personal information. Our Privacy Policy describes this in full.
11. Risk, liability and indemnity
You take part in jobs at your own risk. To the extent the law allows, we are not liable for any loss, injury or damage you suffer in connection with a job, and our liability to you in connection with a job is limited to its fee. You indemnify us against any loss or cost we suffer because you breached these terms or acted unlawfully at a location, and we may set that amount off against payments due to you. Nothing in these terms excludes guarantees under the Australian Consumer Law that cannot be excluded.
12. Suspension and termination
You may stop at any time by ceasing to claim jobs or by asking us to close your account. We may suspend or terminate your access if you breach these terms, submit inaccurate reports, or act unlawfully at a location. Fees for reports already approved remain payable, and clauses 8, 9 and 11 continue to apply after termination.
13. Governing law and contact
These terms are governed by the laws of New South Wales, Australia. Enquiries: support@mysteryshopper.com.au.
